Terms of Use

Terms of Cooperation

You are requested to carefully read the terms of cooperation before using Destinate’s services. These terms have been designed to ensure transparency, security, and proper collaboration between Destinate and its clients. Access to Destinate’s services and the commencement of any cooperation imply unconditional acceptance of these terms, which are binding on all contracting parties.

The terms of cooperation define the rights, obligations, and responsibilities of both the client and Destinate, with the aim of providing services correctly and executing the agreed projects smoothly. If the client does not agree with any of the terms included herein, they should refrain from using Destinate’s services.

Acceptance of Terms of Cooperation

Before using the services, the client is required to carefully study the terms and ensure that they agree to all of them. By accepting the offer or entering into any cooperation, it is considered that the client has been informed and has accepted these terms.

Destinate uses modern technologies and reliable tools for website and e-shop construction, aiming to provide high-quality services. The main platforms used include WordPress—one of the most widespread and reliable content management systems worldwide—and WooCommerce for e-shop development. By mutual agreement, a different technology or platform may be chosen if deemed necessary by the project requirements.

The management system developed by Destinate is designed to be user-friendly, allowing easy content management by the client. During the website or e-shop construction process, additional plugins and design themes may be used, which are managed exclusively by Destinate.

Destinate bears no responsibility for any malfunctions or technical issues arising from third-party interventions on the website, nor from unauthorized changes in settings. Likewise, the company is not responsible for issues caused by malicious attacks such as phishing or hacking via email accounts, although it provides the necessary services for detecting and resolving such problems.

Technical Support & Maintenance

Destinate offers technical support and maintenance services for websites, ensuring proper operation, security, and efficiency of its clients’ online applications. Basic website development packages do not include technical support after project delivery. However, Destinate offers separate support packages, which provide additional services such as periodic updates, backups, technical interventions, and content management.

After the completion and delivery of a website or e-shop, the client receives an initial period of free support covering basic corrections and technical adjustments that may be required for the smooth transition of the project to production. The scope and duration of this support are determined on a case-by-case basis, according to the initial agreement with the client.

Regular maintenance tasks included in the support packages may include:

Software upgrades (CMS, plugins, design themes)

Speed optimization and enhancement of the website’s security

Creation and storage of backups

Preventive checks for potential security issues or malfunctions

Content changes on the website, such as updates to texts, images, and other materials

Support services are provided through separate packages, which include different levels of service such as plugin upgrades, immediate technical assistance, on-site interventions, data recovery, and advanced security services.

If the client does not choose one of the available support packages, any technical support or modifications required after the initial project delivery will be charged separately according to Destinate’s prevailing pricing policy.

GDPR – Personal Data Protection

Protecting personal data is a fundamental operating principle of Destinate. In compliance with the General Data Protection Regulation (GDPR), Destinate ensures that all data collected from clients and website visitors is handled with absolute confidentiality, transparency, and security.

The collection and processing of personal data are carried out solely for purposes related to the provision of our services, communication with clients, support, and improvement of our services. Destinate is committed not to store, use, or share personal data beyond what is strictly necessary to serve the client, unless required by law.

Clients retain full rights over their personal data, including the right to access, correct, delete (right to be forgotten), restrict processing, and transfer their data. Upon request, Destinate is obliged to provide all stored data in a readable format and to delete it if so desired.

Strict security measures are implemented to protect data from unauthorized access, loss, or alteration. Our servers are fully encrypted and follow the latest security techniques to ensure maximum protection of our clients’ information. Additionally, Destinate regularly updates its systems to respond to modern threats and ensures that all personal data remains protected.

Clients can contact Destinate for any matter concerning the protection of their data or submit a personal data management request via email at info@destinate.gr.

Malicious Attacks

The security of our clients’ data is always one of Destinate’s top priorities. However, although we make every effort to ensure data protection, we bear no responsibility in the event of malicious attacks such as hacking, phishing emails, and other similar attacks. We recommend that our clients take appropriate security measures to protect their data, such as using strong passwords and renewing them regularly. We also advise avoiding disclosing sensitive information in unsolicited emails or emails from unidentified sources. In every case, Destinate encourages and insists on communicating with its clients for immediate website updates to avoid such incidents.

Offers

All offers for Destinate’s services are valid for 30 calendar days from their issuance date. After this period, Destinate reserves the right to modify or cancel the offer without notice.

To commence work, the client is obligated to pay a 50% deposit of the total amount, including 24% VAT. The balance must be settled before project delivery. In the event of late payment, Destinate reserves the right to suspend project delivery or refuse transfer to the client until payment is completed.

During project development, Destinate remains in continuous communication with the client, ensuring that the website or e-shop is developed according to the original specifications and requirements. The client must provide the necessary materials (texts, images, videos) in a timely manner for project implementation. Upon project completion, the website structure and content are considered accepted by the client, unless an explicit request for modifications is made, which may incur additional costs.

Destinate issues an invoice within three business days from the service purchase or project completion. Hosting (server) invoices are issued separately.

In the event of a domain name purchase through Destinate, the purchase is made on behalf of the client, and an invoice is issued by the respective registration company (e.g., Papaki, TopHost). Destinate bears no responsibility for potential price increases in domain names or delays in renewal if timely payment by the client has not been made.

Project Delivery Time

Destinate commits to delivering and publishing the website/e-shop within the timeframe agreed upon in the offer or at a later date following mutual agreement with the client. The delivery time begins upon receipt of the deposit and depends on the timely provision of necessary materials by the client (photos, texts, videos, graphics, etc.).

If there is a need to extend the schedule due to technical issues, increased workload, or delays in material provision, Destinate is obliged to inform the client of the new delivery date. If the delay exceeds a reasonable period, the client has the right to request cancellation of the agreement and a refund of their deposit.

Upon project completion, a free round of revisions is provided, covering content corrections and minor structural modifications of the website. Any additional change or modification after delivery is subject to extra charges according to Destinate’s prevailing pricing policies.

The client must designate a specific person as the point of contact for the project’s progress. This person is responsible for gathering and providing the required materials, as well as transmitting any change requests to Destinate’s team.

After project completion and delivery, Destinate provides the client with temporary management credentials for the website. Destinate also creates and provides the necessary professional email accounts for the client’s business (e.g., info@domain.gr, client@domain.gr, support@domain.gr).

For any additional modification or technical support after project completion, the client may choose one of Destinate’s maintenance and support packages, which are tailored to the needs and size of the website.

Training on the Management System (Admin Panel)

At the start of cooperation, Destinate provides 1–2 hours of free training on the website’s management system (Admin Panel). The training is conducted via videoconference using free communication tools such as Google Meets or Microsoft Teams. The goal of the training is to familiarize the client with content management of their website, including texts, images, videos, and other digital elements.

If the client wishes additional training beyond the initial free hours, the cost is €40 per hour. Destinate offers individualized training packages according to the client’s needs, customizing the materials and topics covered.

After training, the client assumes full responsibility for content management and updates. If the client desires Destinate’s support for content changes or updates, a corresponding fee applies under the company’s support and maintenance packages.

Destinate also provides additional advisory services and specialized technical support for optimal use of the management system, tailored to each client’s requirements.

Client Access to the Management System (Admin Panel)

The client gains access to selected settings of their website or e-shop, allowing them to manage content, images, videos, colors, and other visual elements of the platform. They can edit texts, add or remove media, and configure user communication through tools provided by Destinate.

To ensure website stability and functionality, the client does not retain access to the platform’s code. This includes all files related to the site’s structure and operation, such as HTML, CSS, JSON, MySQL database, PHP, React, JavaScript, and other programming languages. All code and related files remain Destinate’s intellectual property and are protected by copyright laws.

Under no circumstances is access to the code files provided, as they constitute Destinate’s asset and are critical to the stability and security of the sites it manages. Any modification or intervention in the code may affect site functionality and cause technical issues or incompatibilities with the content management system.

For additional customizations and technical interventions that the client cannot perform, Destinate offers separate technical support and development services, which can be agreed upon based on project needs and requirements. Any request for additional modifications can be evaluated by Destinate’s team and implemented under a separate agreement.

The client bears responsibility for the correct management of the provided tools and settings. If the client makes changes that negatively impact site functionality, Destinate is not responsible for any resulting errors or issues. If restoration or recovery is required, Destinate can perform it at an additional charge, by agreement.

Additional Charges

The client agrees to indemnify Destinate for any additional features or changes not mentioned in the original agreement and not included in the offer they received. Additional services can be requested at any time during the cooperation, provided there is a written agreement clearly defining their cost.

If technical interventions are required that involve integrations with third-party services, design adjustments that deviate from the original website template, logo modifications, or changes to the site’s structure and content beyond the allocated free revision cycle, Destinate reserves the right to charge extra fees for these services. Fees are determined based on the required work time, complexity of changes, and additional tools or services needed.

If issues arise during cooperation that are not related to the initial website development but are due to external interventions, client or third-party changes, or incompatibilities from software updates, Destinate may undertake remediation of these issues at a corresponding fee, subject to agreement.

Destinate retains responsibility for completing the project according to the original offer and agreed specifications. However, any additional client requirements not included in the original agreement will be evaluated separately and billed according to required time and resources.

Any additions, changes, or technical support beyond the initial agreement must be requested in writing by the client to ensure a clear record of work and associated costs. The client acknowledges that additional charges are necessary for implementing new features or improving their website and commits to paying the corresponding amount according to the specified payment terms.

Copyright & Access to the System

The client retains copyright for all website or e-shop content, including texts, photos, logos, videos, and other multimedia they provide to Destinate. Destinate bears no responsibility for the client’s use of third-party–owned material that may infringe third-party copyrights. The client fully assumes responsibility for content they upload to their site, ensuring they have the necessary usage and publication rights.

The client grants Destinate the right to use and publish the website content for promotional and project presentation purposes. Destinate may include the client’s website in its portfolio or case studies unless the client explicitly states in writing their objection.

All programming code developed by Destinate, including HTML, CSS, JavaScript, PHP, MySQL, React, and other technologies, remains Destinate’s property. This code constitutes intellectual property and is not accessible, as it is protected under copyright law.

Any modification or access to the code requires a special written agreement and may incur additional costs. The client has no right to resell, distribute, or use the website code in other projects without Destinate’s written permission.

After the website is completed and delivered, the client receives access to specific parts of the content management system (CMS), enabling them to manage content, media, products, and contact information. However, the client does not have access to the code, security settings, hosting systems, or server, as these remain under Destinate’s control.

Any modification to the programming code, server settings, or system files must be performed only by Destinate. If the client wishes to obtain full access to management and assume hosting responsibility, they may request website transfer to their own server under agreed terms and associated fees.

If the client desires full transfer of website copyright, this can be done through negotiation and agreement on the corresponding transfer fee.

Mention of Destinate.gr

At the bottom of the client’s website or e-shop, a reference to the site developer Destinate may appear as certification of the project. This reference contributes to transparency and credibility while also indicating the technical support provided by the company.

If the client does not wish for this reference to appear, they must explicitly request its removal in writing before project completion. Should the removal be requested after website completion, an additional fee may apply for modifying the footer or related elements.

The client also agrees that their website or e-shop may be included in Destinate’s portfolio for promotional purposes, showcasing service quality and attracting new clients. Destinate may present website screenshots, include the project in case studies, or mention the collaboration in corporate reports and advertising materials. If the client objects to the use of their website for promotional purposes, they may notify Destinate in writing.

Destinate reserves the right to present its work professionally and ethically, always respecting the client’s commercial and corporate data. Any presentation is made in a manner that does not violate the client’s business interests or strategies.

Web Hosting (Website/E-shop Hosting)

Hosting of the client’s website or e-shop is provided exclusively under Destinate’s full management. Destinate retains exclusive access to site settings, plugins, server management, and website code. For optimal security and functionality, third parties are not granted access without Destinate’s approval.

Under no circumstances can Destinate guarantee proper website operation if a third party intervenes or if the website hosting is transferred to a different server than the one managed by Destinate. The company does not undertake technical management or support for servers owned by the client or third-party hosting providers. If the client wishes to move their website to a different server or gain full management, Destinate can proceed with file delivery and site transfer under a related agreement.

Transferring the website to the client’s personal server means the client fully assumes responsibility for its operation, security, and maintenance. In this case, Destinate is released from all liability for issues arising after transfer. Additionally, Destinate is not obligated to refund any paid amounts for hosting, support, or maintenance services.

The client acknowledges that Destinate fully manages hosting services for websites remaining on its servers, ensuring technical maintenance, security updates, and continuous performance monitoring. Destinate reserves the right to revise its hosting policies and perform server upgrades as needed to maintain high performance and security standards.

In cases where technical interventions or additional support not covered by the initial hosting agreement are required, the client may request additional services, which will be billed separately. Any request for server management changes or technical adjustments will be evaluated and agreed upon by both parties.

Website hosting is a critical element for proper operation, and Destinate reserves the right to suspend hosting services if the client fails to comply with usage terms, misses payments, or takes any action that endangers server security or stability.

Domain Name

Destinate provides domain name registration services on behalf of the client, ensuring proper purchase, renewal, and management of domain names. Payment and renewal of the domain name are the client’s responsibility; Destinate takes necessary actions only after receiving the corresponding payment.

Destinate bears no responsibility for losing a domain name due to the client’s untimely payment. The client is notified by email about renewal dates and is responsible for keeping their domain active. If payment is not made on time, the domain may be lost or returned to availability, allowing third parties to register it.

As part of the management service, Destinate configures the domain name via name servers and provides technical support for its proper functioning. When a domain name is purchased through Destinate, invoicing is done by the collaborating domain provider (such as Papaki, TopHost, etc.) in accordance with that provider’s pricing policy.

Destinate is not responsible for any price increases or changes in pricing policy from domain provider partners. Any cost increase imposed by providers must be covered by the client if they wish to continue domain registration.

Regardless of domain name purchase and cost, Destinate’s domain management, which includes technical configurations, redirects, updates, and support, costs €10 annually. This fee covers continual domain maintenance and management, ensuring its proper operation and optimal performance.

If the client wishes to transfer domain management to another provider or take over management themselves, Destinate can provide the necessary transfer support, provided all related financial obligations have been settled.

Security

Destinate places the highest priority on the security of the websites it manages, implementing strict protection protocols and modern security techniques. It is responsible for activating and managing SSL certificates, as well as configuring the necessary protective measures on hosting servers. Servers hosting client websites are protected by advanced firewalls, malware detection, and automated monitoring systems to prevent cyberattacks.

However, Destinate bears no responsibility for cyberattacks such as hacking, DDoS attacks, malware, spyware, or other malicious actions that may affect website operation. These attacks may be initiated by third parties, and although Destinate takes all possible protective measures, it cannot guarantee absolute security against external threats.

Clients are responsible for keeping their personal credentials secure and following best security practices, such as regularly changing passwords, avoiding weak passwords, and enabling additional protection layers like two-factor authentication (2FA). In case of suspicious activity or security breaches, clients must notify Destinate immediately to take appropriate containment and remediation measures.

For enhanced protection, Destinate offers advanced security services such as continuous security monitoring, preventative updates, and incident recovery, which can be provided upon agreement with the client for an additional fee.

Usage Rights & Warranties

The client declares and warrants that they hold all necessary rights, licenses, and consents to use, publish, and modify the visual material they provide to Destinate for the website’s construction. This material may include photos, graphics, logos, advertising elements, videos, stickers, and other digital media.

The client fully assumes responsibility for securing third-party copyright clearance for the files they submit, ensuring no infringement of trademarks, copyrights, or other third-party rights. Destinate bears no responsibility for any legal consequences arising from using unlicensed or illegally obtained material.

Furthermore, the client agrees to provide any necessary documents or evidence confirming the lawful use of content they post on their website. If it is found that content violates third-party rights, Destinate reserves the right to remove or disable use of such material to safeguard legal compliance and the company’s reputation.

The client grants Destinate permission to use and publish website content for promotional purposes unless they explicitly state otherwise in writing. Destinate may include the website in case studies, portfolios, or other promotional materials solely to showcase service quality.

In case of legal claims from third parties related to the client’s content, Destinate takes no responsibility. The client undertakes to indemnify Destinate for any costs or damages arising from such legal actions.

For protection, Destinate reserves the right to refuse any content deemed to pose legal risks or fall below the company’s quality and ethical standards.

Company Disclaimer

Destinate has no control or oversight over content provided by the client and therefore bears no responsibility for any depiction of logos, billboards, stickers, or other third-party elements that may appear in the visual material. Any potential infringement of third-party rights and any resulting legal, financial, or other consequences are the sole responsibility of the client.

Destinate is not liable for any claims arising from the use or reproduction of client-provided content that belongs to third parties, provided such content is not properly licensed. The client must ensure they have obtained all necessary licenses for using such content and that their website’s content complies with existing copyright and data protection laws.

If legal claims, fines, or other sanctions arise due to publishing unlicensed content, the client bears full responsibility and must indemnify Destinate for any damages, expenses, or legal fees incurred.

Destinate reserves the right to remove any content deemed illegal, offensive, defamatory, or inappropriate without prior notice to protect the company’s integrity and reputation and to comply with the law.

If Destinate becomes aware that client-posted content may violate laws or regulations, it may inform the client of necessary corrections or request immediate removal of the offending material.

Destinate reserves the right to disclaim any liability related to the management, content, or operation of the client’s website and to refuse further services if a breach of the terms of cooperation is detected.

Indemnification Obligation

The client acknowledges and accepts that they are solely responsible for any legal, financial, or operational consequences arising from the use, publication, or management of content provided to Destinate. If claims, legal actions, or damages arise due to third-party rights violations, the client fully assumes responsibility.

The indemnification obligation covers all potential costs that may burden Destinate, including but not limited to legal fees, fines, damages, and attorney’s fees. If Destinate suffers financial or reputational harm due to the client’s actions, it reserves the right to seek full restitution for such harm.

The client commits to cooperating with Destinate to resolve any issue that arises, providing all necessary documents and information requested during legal or out-of-court proceedings. If the client fails to comply with these terms, Destinate reserves the right to suspend or terminate its services.

Destinate also reserves the right to pursue legal action to defend its interests if deemed necessary.

Web Hosting Services

Destinate provides fully managed web hosting services for websites and e-shops, ensuring reliable operation and technical support. The payment period for web hosting services begins on the date the client’s hosting plan is created. Shared Web Hosting services are billed annually, unless otherwise agreed. VPS, Dedicated Hosting, and Cloud Hosting services are paid monthly or annually, depending on the selected package.

Destinate reserves the right to modify hosting service prices, notifying clients at least 30 days before the planned change. In the event of cost increases from third-party server providers, Destinate bears no responsibility, and the client must pay the difference if they wish to continue hosting.

Destinate reserves the right to suspend hosting services in cases of non-payment or violation of usage terms. If the client fails to pay within the specified timeframe, hosting may be temporarily suspended or permanently terminated, with data deletion from Destinate’s servers.

The client has no access to the hosting server or its configurations unless otherwise agreed via a specialized hosting package that allows partial or full management. Destinate undertakes server maintenance and technical support, ensuring continuous and secure website operation.

The client acknowledges that hosting service suspension may affect website accessibility. Destinate is not responsible for data loss, revenue loss, or other damages resulting from hosting suspension or termination due to non-compliance with payment terms.

Destinate may provide optional backup services, DDoS protection, additional storage, and faster server response. These additional services are charged separately and are not included in basic hosting packages.

Destinate reserves the right to modify or remove parts of the client’s website during hosting if deemed necessary for security, maintenance, or compliance with technical specifications. Any modification will be made after notifying the client.

SSL Security

Destinate recognizes the importance of protecting personal data and implements modern security technologies to ensure user and website safety. One of the primary measures is using SSL (Secure Sockets Layer) encryption, which protects communication between users and the website.

SSL encryption ensures that all data transferred to and from the website is encrypted and protected from interception or unauthorized access. By using a valid SSL certificate, users can browse securely, and their transactions and personal information remain confidential.

Destinate handles SSL certificate activation and management on client websites, ensuring all necessary security protocols are followed. Furthermore, Destinate monitors SSL certificate validity and renews certificates as needed to prevent interruptions in secure site operation.

SSL activation is mandatory for all websites hosted by Destinate, as it is a key criterion for user protection and compliance with search engine guidelines. Websites without SSL may appear as “not secure” to visitors and may face functionality restrictions.

For clients seeking additional security, Destinate offers advanced SSL certificates with higher protection levels, such as OV (Organization Validation) and EV (Extended Validation), which provide extra security assurances and enhance website credibility.

Destinate is not responsible for access issues or security warning displays on client websites with expired or invalid SSL certificates. The client must inform Destinate of any security-related problems so that appropriate remediation measures can be taken.

SSL encryption is one of Destinate’s core security specifications, contributing to a safe and reliable online environment for businesses and users.

Informational Emails (Newsletters)

Destinate sends informational emails (newsletters) at regular intervals to users who have shown interest in our services. These emails aim to inform clients about our services, new technologies in website development, important technical updates, and tips for improving their online presence.

Destinate’s newsletters include:

Updates on new services and improvements to existing offerings

Tips and technical articles for effective website management and maintenance

Announcements of promotions or special discounts on hosting, technical support, and website development services

Important information regarding security matters, GDPR, and CMS platform updates (such as WordPress).

If informational emails are directed to the spam folder, we recommend configuring your email filter to recognize messages from Destinate as safe by adding our address to the allowed contacts list.

If you no longer wish to receive newsletters, you can unsubscribe at any time via the link at the bottom of each email. Alternatively, you can send an email request to info@destinate.gr, and our team will promptly remove you from the recipient list.

Destinate is committed to using users’ email addresses solely for informational and promotional purposes, without sharing them with third parties. Newsletter distribution complies with applicable data protection laws, and clients have the right to manage their communication preferences at any time.

Final Provisions – Amendment of Terms

Destinate reserves the right to modify, revise, or update these terms at any time without prior notice. Changes to the terms will be published on Destinate’s official website and will be binding on all clients from the moment of publication. Clients are obliged to check the terms periodically for any modifications.

All terms of cooperation are governed and interpreted according to Greek law. In the event of disputes arising from cooperation with Destinate, the parties involved agree to make every effort for out-of-court resolution. If out-of-court resolution is not possible, disputes will be resolved by the competent courts of Athens.

Any deviation from the terms of cooperation or special exception applies only if it has been agreed in writing between the parties. If any part of the terms is deemed invalid or unenforceable by a competent court, the remainder of the terms will remain in full force.

Clients acknowledge that Destinate is not responsible for force majeure events, such as natural disasters, cyberattacks, strikes, technical problems of third-party providers, or other circumstances beyond its control, which may affect service provision.
